THE SUBJECT OF THE AGREEMENT

The Buyer's electronic order from thecariacarrental.comwebsite, which includes the qualities mentioned in the contract and the sale and delivery of the goods/services specified in the contract, is subject to the determination of the rights and obligations of the parties in accordance with the provisions of the Consumer Protection Law No. 4077 and the Regulation on Distance Contracts Application Principles and Procedures.

The Buyer acknowledges that they are informed about the basic characteristics of the goods/services subject to the sale, the sales price, payment method, delivery conditions, etc., and the 'right of withdrawal,' confirms these preliminary information electronically, and subsequently orders the goods/services in accordance with the provisions of this contract. The TERMS OF USE and TRANSFER TERMS on the https://cariacarrental.com payment page are integral parts of this contract.

DATE OF THE AGREEMENT

The dates covered by the service requested by customers from https://cariacarrental.com are essential.

DELIVERY OF GOODS/SERVICES, PLACE OF PERFORMANCE OF THE AGREEMENT, AND METHOD OF DELIVERY

The service provided by the seller is provided according to the transfer location determined by the customer and the method specified by the customer when requesting the service.

DELIVERY COSTS AND PERFORMANCE

Delivery costs are borne by the buyer. If the seller has declared that the fee of those who request the service above the announced amount will be covered by the seller or that free delivery will be made within the campaign, the delivery cost belongs to the seller. If, for any reason, the price of the goods/services is not paid or canceled in the bank records, the seller is deemed to have been exempted from the obligation to deliver the goods/services, and the relevant transaction is carried out in accordance with the TRANSFER TERMS previously published on the website.

DECLARATIONS AND UNDERTAKINGS OF THE BUYER

If the right of withdrawal will be used, the goods/services should not be used. The invoice must be returned. If, after the delivery of the goods/services, the buyer's credit card is used by unauthorized persons in an unjust or unlawful manner, and as a result of this use, the bank or financial institution does not pay the price of the goods/services to the seller, the buyer is obliged to send the goods/services to the seller within 3 (Three) days, provided that they have been delivered. In this case, delivery costs are borne by the buyer.

CHARACTERISTICS OF THE GOODS/SERVICES SUBJECT TO THE AGREEMENT

The type and kind of the goods/services, quantity, brand/model, color, and the total price, including all taxes, are as stated in the presentation page of the goods/services onwww.cariacarrental.comand as stated in the invoice, which is an integral part of this contract.

ADVANCE PRICE OF GOODS/SERVICES

All prices oncariacarrental.comwebsite include VAT and all other taxes (subject to changes in these taxes) unless otherwise stated on our website or in the confirmation e-mail. In case of payment by credit card and in installments, the installment form selected by the buyer on the website is valid. In installment transactions, the relevant provisions of the contract signed between the buyer and the cardholder bank apply. The credit card payment date is determined by the agreement between the bank and the buyer. In some vehicles on our website, only the condition of prepayment may arise as a payment option. Commission deductions and responsibilities arising from the bank to be transferred are the responsibility of the sender.

CANCELLATION AND AMENDMENT

If the consumer requests cancellation up to 12 hours before the service starts, the full amount of the service fee paid will be refunded. If the consumer requests cancellation within less than 12 hours before the service starts, 50% of the one-way service fee will be refunded (if the round-trip service fee has been paid, the entire return fee will be refunded). These conditions do not cover promotional services, early reservations, or discounted reservations. The cancellation provisions apply to changes in dates made by the consumer. The consumer agrees to comply with the service contract rules regarding the service purchased from the agency, and that they will respect the lives, property, and peace of third parties; otherwise, they acknowledge that they cannot receive the service for a justifiable reason, and there is no right of withdrawal. If, after the performance of the service, the consumer's credit card is used by unauthorized persons in an unjust or unlawful manner, and as a result, the bank or financial institution does not pay the service fee to the agency, the consumer is responsible for the service fee and damages.

GENERAL PROVISIONS

In case of mechanical breakdown, traffic accident, operational failures, adverse weather conditions, traffic congestion, terrorist incidents, law enforcement practices, etc., which may cause a hindrance to the transfer in the transfer vehicle, as soon as it is understood by the agency, an alternative vehicle will be provided as soon as possible and/or information will be provided in case of the opposite situation. In the above-mentioned cases, the refund of the transfer fee paid will be refunded to you without any deductions, and/or in such a case, the price difference arising from the transportation provided by the consumer's own means will also be paid to the consumer by the agency.

VALIDITY

If necessary, this contract will be drawn up in 2 copies and signed by the parties, and in case of disputes arising from this contract, the provisions of the Road Transport Law No. 4925 will apply. Ankara courts and enforcement offices are authorized in case of disputes arising from this contract. I declare that I have read and accepted all the provisions stated in the Web Site Distance Sales Agreement and 'Terms and Conditions' pages that have been prepared on behalf of me as a consumer, the accuracy of the information included in the reservation form I have sent, and that I have read, understood, and accepted the Road Transport Law No. 4925 and the information on the agency's website, whether I have read it myself or on behalf of others who are indicated in the reservation form.
